Abstract:Whether Double Compensation prescribed in the 49^th provision of Consumer Law is applicable to the market house business is being disputed. This essay affirms in principle that Double Compensation is applicable to the market house business through jurisprudence analysis. Basing itself on the technical and economical characteristics of the architecture, it also analyzes the principle, scope and measurements of the applicability. Moreover, it indicates the positive meaning towards regulating the real estate business in China, if Double Compensation is applied in market house business, and deficiency of the judicatory commendation issued lately by the Supreme Court concerning Double Compensation.
